Terms of Use

These terms govern your use of lodestock.com (the site). They are about the site itself — your account, what you may and may not do here, and who is responsible for what. The contract for anything you actually buy is covered separately by our Terms of Sale.

By using the site you accept these terms. If you do not accept them, please stop using the site.

1. Who we are

The site is operated by NanoSoft Corporation Limited, a company registered in England and Wales under company number 06579146, trading as Lodestock. Our registered office is Unit 8-9 Maldon Trade Park, The Causeway, Heybridge, Maldon, England, CM9 4LJ.

2. Using the site

You may browse, search and buy from the site for your own purposes, whether personal or business.

You must not:

  • use the site in any way that breaks the law, or that is fraudulent or deceptive;
  • interfere with the site, its security, or anyone else's use of it;
  • scrape, harvest or systematically copy content, listings or images except as a search engine indexing the site normally;
  • attempt to gain access to any account, system or data that is not yours;
  • resell or republish our listing content as though it were your own.

We may suspend or withdraw access to the site, in whole or in part, at any time. We try to keep the site available but we do not promise it will be uninterrupted or error-free.

3. Your account

You do not need an account to buy from us, but you do need one to see your order history, manage addresses, use a trade account or track a trade-in.

When you create an account you agree to:

  • give accurate information and keep it up to date;
  • keep your password confidential and not share your account with anyone else;
  • tell us promptly if you think someone else has used your account.

You are responsible for everything done through your account unless it was our fault. We may suspend or close an account that has been used in breach of these terms, or where we reasonably suspect fraud.

You can close your account at any time by emailing us. Closing an account does not cancel orders already placed or affect records we are required to keep, such as invoices.

4. Trade accounts

Business customers may apply for a trade account. Approval is at our discretion, and any credit limit or payment terms we agree are set out separately in writing. Trade purchases are business-to-business sales: the consumer rights described in our Terms of Sale, including the 14-day right to cancel, do not apply to them.

5. Product information and availability

We describe every item as accurately as we can, including its condition grade and any cosmetic marks. Photographs are illustrative; colour reproduction varies between screens, and for graded stock the exact unit you receive may differ cosmetically from the photograph within the limits of its grade.

Listings are an invitation to buy, not an offer. Availability, specifications and prices can change, and a listing may occasionally show an error. What happens if we cannot fulfil an order at the price shown is set out in our Terms of Sale.

6. Our content

All content on the site — text, layout, graphics, logos and photography — belongs to us or our licensors and is protected by copyright and trade mark law. You may view it, and print or download extracts for your own use in connection with buying from us. You may not use it commercially without our written permission.

"Lodestock" and our logo are our trade marks. Manufacturer names and model numbers are the trade marks of their owners and are used only to describe the equipment we sell. We are not affiliated with, endorsed by or an authorised reseller for those manufacturers unless a listing says so.

7. Reviews and anything you submit

If you submit a review, question or other content, you must own it or have the right to submit it, and it must not be unlawful, misleading, offensive or an infringement of anyone's rights. You keep ownership of what you submit but give us permission to display and reproduce it in connection with the site.

We may decline to publish, or may remove, anything that breaks these rules. We do not remove a review simply because it is unfavourable.

8. Links to other sites

The site may link to other websites, such as a courier's tracking page. Those sites are not under our control and we are not responsible for their content or their handling of your data.

9. Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that:

  • if you are a consumer, we are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill, but not for anything unforeseeable, and not for losses connected with using the site for a business purpose;
  • if you are a business, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, and our total liability arising out of your use of the site is limited to £1,000.

10. Data and cookies

How we handle personal data is set out in our Privacy Policy. How the site uses cookies, and how you can change your preferences, is set out in our Cookie Policy.

11. Changes

We may update these terms. The version published on the site when you use it is the version that applies. Material changes will be flagged on the site.

12. Law and disputes

These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you keep the benefit of any mandatory protections of your local law and may bring proceedings in your local courts.
