Terms of Sale
DRAFT — solicitor review required before launch. This wording has been prepared in-house as a working draft. It has not been checked by a qualified lawyer and must not be relied on as legal advice.
These terms cover what you buy from us. We sell our own stock: when you order from Lodestock, your contract is with NanoSoft Corporation Limited (company number 06579146), and we are the seller and the one responsible to you.
Rules about using the site itself are in our Terms of Use.
1. Refurbished equipment, and what a grade means
Almost everything we sell is used or refurbished business IT equipment. That is the whole point: it costs less than new, it has been tested, and it comes with a warranty.
Every listing carries a condition grade, and the grade is part of the description of the goods:
- Grade MFR — manufacturer refurbished. As-new condition.
- Grade A — excellent. Minimal signs of use.
- Grade B — good. Light cosmetic marks that do not affect use.
- Grade C — fair. Visible cosmetic wear. Fully working.
Cosmetic marks consistent with the stated grade are what you have agreed to buy, and are not a fault. Anything that stops the equipment working as it should is a fault, whatever the grade. Our grading guide explains this in more detail.
2. Placing an order
Adding items to your basket and paying places an order. That is an offer to buy, not yet a contract.
The contract forms when we send you an email confirming the order has been dispatched. If we cannot supply an item — because it has sold, or a listing showed the wrong price and the error was obvious — we will tell you and refund you in full. We do not have to sell at an incorrectly displayed price.
Payment is taken at checkout by card through Stripe. We do not see or store your full card details.
3. Prices and delivery
Prices are in pounds sterling and are shown on the site. Delivery costs are shown before you pay and are set out on our Shipping page.
We will deliver within 30 days of the contract forming unless we have agreed otherwise with you. Estimated delivery dates are estimates, not guarantees; we are responsible for delays we could have avoided, not for those we could not.
The goods are your responsibility once they are delivered to the address you gave us. They remain our property until we have received payment in full.
If nobody is available and the goods cannot be left safely, the courier will leave a card. If an item comes back to us undelivered after reasonable attempts, we will contact you; we may charge the actual cost of redelivery.
4. Your right to change your mind — consumers
If you are a consumer buying at a distance, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel.
- You have 14 days from the day you receive the goods to tell us you are cancelling. You do not have to give a reason.
- Tell us by emailing support@lodestock.com with your order number, or by using our returns process.
- Send the goods back within 14 days of telling us.
- We refund within 14 days of getting the goods back, or of you showing you have sent them, whichever is sooner.
We refund the price you paid plus our standard outbound delivery charge. If you chose a faster delivery than our standard one, we refund the standard cost, not the premium.
Return postage is on you unless the item is faulty or not as described, in which case we pay.
You can inspect and handle the goods as you would in a shop. If you go beyond that and the value drops as a result — parts missing, damage caused while you had it, an activation lock still set — we may reduce the refund to reflect it.
We may withhold a refund on a device that has not been signed out of its accounts or that still has an activation lock in place, since we cannot resell or verify it in that state.
5. Faulty or misdescribed goods — consumers
Your legal rights under the Consumer Rights Act 2015 apply in full. The goods must be of satisfactory quality, fit for purpose and as described — judged against the description we gave, including the condition grade and any noted marks.
If they are not:
- Within 30 days of delivery you may reject them and get a full refund.
- After 30 days and within 6 months you may ask us to repair or replace them. If that fails, or is not possible, you may claim a refund, which may be reduced to reflect the use you have had.
- After 6 months the same rights apply, but you may need to show the fault was present when the goods were delivered.
These rights are in addition to, and never replaced by, the warranty below. We pay return postage on anything faulty.
6. Warranty
Every item carries the warranty period shown on its listing, running from the delivery date. See our Warranty page for what it covers and how to claim.
The warranty covers hardware failure in normal use. It does not cover accidental damage, liquid damage, damage from misuse or unauthorised repair, consumable wear such as battery capacity declining over time, or software and data problems.
We may repair, replace or refund. If we replace, the replacement carries the remainder of the original warranty.
7. Business customers
If you are buying in the course of a business, the consumer rights in sections 4 and 5 do not apply. Instead:
- you must inspect the goods on delivery and tell us about any shortage, damage or misdescription within 7 working days;
- the warranty in section 6 still applies;
- our total liability for any order is limited to the price you paid for it, and we are not liable for loss of profit, loss of business, business interruption or loss of data;
- the Sale of Goods Act 1979 implied terms apply only to the extent they cannot lawfully be excluded.
Trade account terms, where we have agreed them with you in writing, take precedence over this section.
8. Data on devices you send us
If you send us equipment — a return, a warranty claim or a trade-in — remove your data and sign out of any accounts first. We wipe every device we receive as part of processing it, and we cannot recover or return data from a device once it has been wiped.
9. Complaints
Email support@lodestock.com with your order number. We aim to acknowledge within one working day and resolve within five.
If we cannot resolve it between us, a consumer may be able to use an alternative dispute resolution scheme, and may in any event take the matter to court. Nothing here affects your statutory rights.
10. Law
These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you keep the benefit of any mandatory protections of your local law and may bring proceedings in your local courts.
